The VOC was represented at this meeting by the Vice Chairperson and two other members all of whom have been particularly active on this matter. throughout The minute below, edited by City Management, was disappointing by its outcome and content. The shortcomings were covered and minuted at the VOC meeting of 25t November 2021. Notably:
- CM did not agree to an audio recording of the meeting
- CM did not agree to use the Small Claims Tribunal on a second long term debtor to get a legal judgment on the method of calculation of interest we should use.
- CM reported that they had recently negotiated a deal ( which we consider favourable to the long-term debtor) without informing the VOC and likely outside the terms of the Deed of Mutual Covenant.
- The details of the negotiated settlement, have been promised to the VOC, but have not been presented at the time of writing.
- In the view of our legal professionals there have been breaches of contract
- Ernest Lee advised that he is the person who is in overall charge of collecting the debt and has all the authority so to do.
- Both CM and the VOC members conceded that either of their respective interpretations of the DMC, simple interest or compound interest, could be what the DMC intends
